TERMS AND CONDITIONS

1.    SHIPMENT

Specially Made Gifts will not be responsible for any wrong information that the client has provided. Kindly double check all details such as the delivery address and contact number. Clients will always be notified via email once your order is shipped. Our partner service provider will only attempt to deliver two (2) times and will contact the recipients through the provided details. If necessary, the client shall leave any authorization letter if they will not be able to receive the package personally. An unsuccessful delivery will be returned to our headquarters and shipment fee will still be collected. Reshipping will be subject to an additional delivery fee.

Our company and our partner couriers will not be held liable for loss, delay, or damage that arise from acts of God, force majeure, or acts of government authority.

 

2.    RETURN AND REFUND

All Return and Refund cases filed will undergo an evaluation process by our team. We may require photos and/or documents related to the concerns which will be used as part of the investigation. Issues will be resolved within seven (7) business days, on a case-to-case basis where applicable.

Since all items are customized and personalized, we require full payment and will not entertain returns or cancellations once orders are deemed final for production. Any changes in the order detail after your payment will be considered on a case-to-case basis. To reconfirm the product and design orders, all paid orders will receive an email notification from us, updating you that the status is now for production. Failure to reply and reconfirm the order details within twenty-four (24) hours will automatically mean that the order is good to go for production - with the exception of embroidered logos and artworks, which require programming, client's approval for this is mandatory. 

 

A refund or exchange may be filed for any of the following reasons:

a)     Wrong item received

Wrong item, color, size, or any other order details. This will be checked against the details as agreed on the invoice and final instructions attached. 

b)     Lost

Once your order is shipped out, you will be notified via email. The email will contain the tracking link and the estimated delivery date. The order will be considered as loss in transit if it is not delivered within seven (7) up to ten (10) days after the estimated date of delivery. You can file for a claim immediately ten (10) days after the estimated date of delivery.

c)     Damaged items

Damage on items should be reported within twenty-four (24) hours after receipt. Failure to do so will free Specially Made Gifts and its partner couriers from any responsibilities.

d)     Delay in Delivery

Since all deliveries are handled by a third-party courier, we will not be held liable for any delays. Only the shipping fee may be refunded after proper evaluation.

Standard delivery time:

  • 3-5 days for Metro Manila (excluding holidays)
  • 7-10 days for Provincial (excluding holidays)
  • For international shipping, this will be indicated upon checkout.

Note: Production time + delivery time = total lead time

e)     Unfulfilled order

Full refund. No questions asked.

 

3. FORCE MAJEURE

Neither Specially Made Gifts nor the clients shall be liable to the other for any delay or failure to produce or receive the orders under the transaction where such reason is directly caused by a Force Majeure Event. Both parties shall exercise reasonable efforts and cooperate with each other on the appropriate measures to be taken to settle the excusable delay or failure and/or its consequences.

 

4.    COPYRIGHT PERMISSION

We respect intellectual property rights. Kindly make sure that you have ownership or permission from the copyright owner to use the design or file uploaded.

Ordering through our shop means that the client is agreeing to the following terms:

  • I have commercial rights to use and reproduce the design;
  • I understand illegal use of third party copyright content is a serious offence and can lead to have corresponding penalties; 
  • If any legal issues arise, they will be directed to me and I am responsible to make the necessary actions.

 

5. USE OF ACCOUNT

Specially Made Gifts has access to all the details you may have disclosed through the use of this website. Please see our privacy policy for more information regarding this. In the same way, we have the right to terminate and delete any account, detail, or file as deemed inappropriate without prior notice. Reasons may include but are not limited to illegal use of any logos/artworks, identity theft, and inappropriate or obscene use of words/photos. Specially Made Gifts will not be held liable for any losses, damages, and costs caused by the termination or removal of the accounts.

 

By using this website and transacting with Specially Made Gifts, the user agrees that he/she has read and understood the terms and conditions. If any legal actions arise from these Terms, it shall be brought to the proper court of Quezon City, Philippines.
